Terms & Conditions – NexSite Agency

By accessing or using the services provided by NexSite Agency, you (“Client”) agree to the following Terms and Conditions.
1. Services
NexSite Agency provides custom website design, development, copywriting, SEO optimization, testing, launch, and ongoing maintenance. All projects are individually priced based on scope and requirements.
2. Project Process & Approval
Each project includes a complete website design preview before payment.
If the Client approves the design, the agreed payment becomes due.
If the Client does not approve the design or changes their mind before approval, no payment is required, and the project is closed.
3. Payment & Fees
Full project payment is required once the design is approved.
A monthly maintenance fee applies to all active websites hosted under NexSite Agency.
If a payment is missed or refused, the website may be temporarily suspended until payment is received. Late payments can be discussed and resolved without penalty at the discretion of NexSite Agency.
4. Ownership & Rights
All websites are hosted under NexSite Agency’s hosting account.
NexSite Agency retains ownership of all website files, code, and design materials.
Clients may use the website as long as monthly maintenance payments are active and up to date.
Once a client stops paying for maintenance, NexSite Agency reserves the right to remove or deactivate the website.
NexSite Agency may only use the website design or project in its portfolio with the client’s explicit approval.
5. Client Responsibilities
Clients are responsible for purchasing and maintaining their own domain name(s).
If the Client wishes to include specific images, text, or other materials, these must be provided before or during development.
Delays in feedback or missing materials may extend delivery timelines but will not cancel the agreement.
6. Delivery Timeline & Revisions
Typical project timelines range from two (2) to three (3) weeks, depending on size and complexity.
Minor adjustments are included; major redesigns or feature changes may incur additional fees.
7. Maintenance & Support
The monthly maintenance fee includes:
Hosting and uptime management
Security updates and bug fixes
Occasional SEO adjustments when needed
Minor website updates upon client request
Major structural changes or redesigns are not included and will be quoted separately.
8. Reliability & Liability
NexSite Agency aims to keep all websites secure and functional at all times.
However, occasional technical issues or downtime may occur.
NexSite Agency is not liable for temporary interruptions, data loss, or indirect damages of any kind.
In case of any issue, reasonable efforts will be made to restore or fix the website promptly.
9. Cancellations
If the Client cancels before design approval, no payment is required.
If the Client cancels after approval or after the website has been active for several months, all outstanding payments must be settled, including the current month’s maintenance fee.
10. Limitation of Liability
NexSite Agency’s total liability for any claim shall not exceed the total amount paid by the Client.
NexSite Agency is not responsible for lost profits, data loss, or indirect damages.
All services are provided “as is,” without guarantees beyond those explicitly stated.
11. Governing Law & Jurisdiction
All agreements and services provided by NexSite Agency are governed by Swedish law.
Any disputes arising under these Terms shall be exclusively resolved in the courts of Sweden.
